These Terms of Use ("Terms") govern your use of Mugzilla (the "App"), which is operated by Foundry Pixel ("Foundry Pixel," "we," "us," or "our"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are 18 or older. If you are under 18, do not use the App.
Subject to these Terms, Foundry Pixel grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the App for your own personal, non-commercial entertainment use.

Mugzilla may offer optional paid subscriptions, free trials, and in-app purchases through Apple's App Store and Google Play Store.
Pricing, billing periods, free trial availability, renewal terms, and applicable taxes will be shown in the App and/or on the applicable store purchase screen at the time of purchase.
Unless cancelled at least 24 hours before the end of the current subscription period, subscriptions automatically renew. Payment will be charged to your Apple ID or Google account at confirmation of purchase, or at the end of any applicable free trial period.
You can manage or cancel subscriptions through your Apple or Google account settings.
We may change subscription offerings, features, pricing, packaging, or trial terms prospectively as permitted by applicable law and app store rules.
You retain ownership of the photos and other content you submit through the App ("User Content").
By submitting User Content, you grant Foundry Pixel a limited, non-exclusive, worldwide, royalty-free license to host, transmit, process, and analyze that User Content only as reasonably necessary to provide the requested features, operate and secure the App, prevent abuse, troubleshoot and fix service issues, comply with legal obligations, and otherwise as described in our Privacy Policy.
Submitted photos are not used for advertising or AI model training by us, as further described in our Privacy Policy.

Mugzilla generates AI-created commentary for entertainment purposes only.
Outputs may be inaccurate, exaggerated, offensive, incomplete, inconsistent, or inappropriate. The App does not provide medical, psychological, legal, financial, employment, insurance, dating, or other professional advice, and its outputs should not be treated as factual statements or real-world evaluations of attractiveness, character, worth, identity, or suitability.
The App is not a facial recognition, identity verification, or biometric identification service.
The App may rely on third-party providers, including Apple and Google for billing and subscription management and third-party infrastructure or AI service providers to help operate the App.
Foundry Pixel is not responsible for third-party services, websites, or policies, except to the extent required by law.
The App, including its software, design, trademarks, branding, text, graphics, and other content provided by Foundry Pixel, is owned by Foundry Pixel or its licensors and is protected by intellectual property and other applicable laws.
Except for the limited license expressly granted above, no rights are granted to you.
We may suspend, restrict, or terminate your access to the App at any time, with or without notice, if we reasonably believe that:

To the fullest extent permitted by law, the App is provided on an "as is" and "as available" basis, without warranties of any kind, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment, and availability.
We do not warrant that the App will be uninterrupted, error-free, secure, or free from harmful components, or that any output will be accurate or suitable for any purpose.
To the fullest extent permitted by law, Foundry Pixel and its affiliates, licensors, service providers, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, use, data, or business interruption, arising out of or relating to your use of or inability to use the App.
To the fullest extent permitted by law, Foundry Pixel's total aggregate liability for any claim arising out of or relating to the App or these Terms will not exceed the greater of:

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Foundry Pixel and its affiliates, officers, directors, employees, contractors, and agents from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:
Apple: This App is licensed to you, not sold. Apple Inc. is not a party to these Terms and has no obligation to provide maintenance, support, or warranty for the App. In the event of a failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); Apple has no other warranty obligation. Apple is not responsible for any claims relating to the App, including product liability, regulatory compliance, or intellectual property. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
Google: Google LLC is not a party to these Terms and has no obligation to provide maintenance, support, or warranty for the App. Google is not responsible for any claims relating to the App, including product liability, regulatory compliance, or intellectual property.
We may update these Terms from time to time. If we make material changes, we will post the updated Terms and revise the Effective Date and Revision number above. Your continued use of the App after the updated Terms become effective means you accept the revised Terms.
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles, except where consumer protection law in your jurisdiction requires otherwise.
Any dispute arising out of or relating to these Terms or the App will be brought exclusively in the state or federal courts located in the State of Washington, unless applicable law requires otherwise.
